WATT SO EVER — END-USER LICENSE AGREEMENT Version 2026-09-28 Please read this agreement before using WATT SO EVER ("the app"). By selecting ACCEPT you agree to it. If you do not agree, select DECLINE AND QUIT; the app closes and you can uninstall it. The agreement stays available in the app under Settings → About → Licenses. 1. WHO WE ARE The app is a private, non-commercial hobby project of Tobias Kloos, Munich, Germany ("the licensor"), contact: wattsoever.cc@gmail.com, website: https://wattsoever.cc. The app is free of charge. It has no price, no advertising, no in-app purchases and no user accounts. 2. WHAT YOU MAY DO You receive a free, non-exclusive, non-transferable licence to install and use the app on computers you own or control, for your own personal, non-commercial training. People in your household may ride with your installation. 3. WHAT YOU MAY NOT DO (a) Sell, rent, lend, sublicense or otherwise distribute the app or copies of it. Please point others to https://wattsoever.cc instead. (b) Use the app commercially, for example in a paid gym, studio or coaching service. (c) Remove or change copyright, licence or attribution notices, including the map and data credits. (d) Modify, decompile or reverse engineer the app, except where mandatory law allows it (for example to achieve interoperability) or where the licence of a third-party component grants that right. (e) Extract, bulk-download or redistribute map tiles, imagery or elevation data shown in the app, or use them outside the app. (f) Use the app in a way that breaks the law or the terms of a third-party service described in section 5. 4. THIRD-PARTY COMPONENTS The app contains software, fonts, icons and data from third parties. Each is licensed under its own terms, listed with the complete texts under Settings → About → Licenses. For those components their own licence terms apply and take precedence; nothing in this agreement restricts the rights they grant you. Their suppliers are not parties to this agreement: they give you no warranty and accept no liability through it. The licensor's own work remains protected by copyright; all rights not granted here are reserved. 5. THIRD-PARTY ONLINE SERVICES The app runs on your computer and does not send your rides, profiles or routes to the licensor. Some features contact services of other companies directly from your computer. These services are not operated by the licensor; their providers' own terms and privacy policies apply, they may change, limit or stop a service at any time, and the licensor cannot guarantee that they are available. The licensor is not affiliated with or endorsed by any of them. A future update may remove or replace a service. Whenever the app contacts a service, the provider receives your IP address and the usual technical request data (time, requested address and, for map, terrain and elevation requests, the app identifier "wattsoever"). In addition: • OpenFreeMap (Hyperknot Software Kft., Hungary; delivered through Cloudflare, Inc., USA) — MAP layer in route, ride and report views. Receives the map tiles you look at, which reveal the approximate area of your route; the app never downloads map areas in advance. Tiles you have viewed are kept on your computer, so those areas also work offline. Map data © OpenMapTiles, © OpenStreetMap contributors, Open Database License. Terms: https://openfreemap.org/tos/ — privacy: https://openfreemap.org/privacy/ • Map sources you add yourself (Settings → MAPS) — loaded directly from the provider you entered, with the key you entered; the app does not proxy or store their tiles. That provider's terms and privacy policy apply, and you are responsible for being allowed to use the source in this way. • Terrain tiles on AWS Open Data (Amazon Web Services, USA; Mapzen / Tilezen data) — relief shading and contour lines, the TERRAIN layer and 3D views, and a terrain cache along a route when you import a GPX file. Receives the terrain tiles along your route. Source credits: https://github.com/tilezen/joerd/blob/master/docs/attribution.md — privacy: https://aws.amazon.com/privacy/ • Open Topo Data public elevation API (opentopodata.org) — when you import a GPX route, and when the app recalculates the elevation profile of a route you imported. Receives the coordinates of your route (a point about every 20 m), which can reveal places such as your home. Its operator describes the public API as intended for testing and publishes no terms or privacy policy of its own. You can avoid it by using a self-hosted Open Topo Data server. Service: https://www.opentopodata.org/ • Strava (Strava, Inc., USA) — only if you use STRAVA CONNECT or STRAVA UPLOAD. The app opens strava.com in its own window; you sign in directly with Strava, and the app never sees your password. When you upload, the app selects the ride's FIT file in Strava's upload form and pre-fills its title, description and tags; you review everything and save the activity yourself. Strava's sign-in is stored on your computer, separately for each rider profile. The app is not affiliated with or endorsed by Strava, and a change to Strava's website can stop this help from working. Strava's terms apply to your Strava account and uploads, and you are responsible for following them: https://www.strava.com/legal/terms — privacy: https://www.strava.com/legal/privacy • Microsoft Edge WebView2 Runtime (Microsoft Corporation, USA; Windows only) — the app window uses Microsoft's WebView2 runtime. If it is missing, the installer downloads Microsoft's installer for it directly from Microsoft. Microsoft licenses the runtime to you under its own terms, which you accept by using it: https://developer.microsoft.com/microsoft-edge/webview2/ — it sends diagnostic data to Microsoft according to your Windows settings, and Microsoft Defender SmartScreen, when enabled, checks web addresses and downloads with Microsoft. Privacy: https://privacy.microsoft.com/privacystatement Links in the app, such as the website or the licence and data sources above, open in your web browser only when you select them. Bluetooth connections to your trainer and heart-rate strap stay between your computer and those devices. 6. YOUR DATA Rider profiles, workouts, routes, ride recordings and FIT files are stored in the app's data folder on your computer. You are responsible for backing them up. Deleting a rider profile also deletes the Strava sign-in the app stored for it; files you exported or uploaded elsewhere are not affected. 7. HEALTH AND SAFETY Indoor training can be physically very demanding. Consult a physician before you start training, especially if you have a medical condition, are pregnant, take medication or have not exercised for a long time. Stop immediately if you feel pain, dizziness, shortness of breath or discomfort. The app controls your trainer's resistance in ERG and SIM modes and can make pedalling hard. Set up the trainer and bike according to the manufacturer's instructions, keep children and pets away from moving parts, and make sure you can stop at any time. Power targets, FTP estimates, calculated speed, distance, climb, training load and all other values are estimates for training purposes. The app is not a medical device and does not diagnose or treat anything. If other people ride with your installation, make them aware of this section. Minors should only use the app with the consent and supervision of a parent or guardian. 8. NO WARRANTY The app is given away free of charge and provided as it is. The licensor gives no guarantee and, to the extent permitted by law, no warranty — in particular not that the app is free of errors, works with every trainer, computer or operating system, or that the third-party services in section 5 are available. The licensor has no obligation to provide updates or support. 9. LIABILITY The licensor is liable without limitation for intent and gross negligence, for defects the licensor fraudulently concealed, and under the German Product Liability Act where it applies. Liability for injury to life, body or health is governed by statutory law and is not limited by this agreement. In all other cases the licensor is not liable for slight negligence. Where the law of your country does not allow these limitations, they apply to the maximum extent it permits. 10. UPDATES, CHANGES AND END OF THE AGREEMENT If this agreement changes, the app shows the new version and asks for your acceptance before you can continue. You can end the agreement at any time by uninstalling the app and deleting its data folder. If you breach this agreement, your licence ends automatically. Sections 4, 8, 9 and 11 continue to apply. 11. LAW AND LANGUAGE This agreement is governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you use the app as a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the country where you habitually reside. The agreement is written in English, which is the language of the app. If a provision is invalid, the rest of the agreement remains valid. Product and company names such as Wahoo, KICKR, Strava, Komoot, OpenStreetMap and OpenFreeMap are trademarks of their respective owners and are mentioned only to describe compatibility or data sources.
